The long-awaited and 50th meeting of the GST council came to an end with a number of very important statements following closely behind. There were a number of different cards on the table, ranging from the imposition of taxes on online games to the inclusion of the GST network under the scope of the legislation that prevents the laundering of illicit funds.

The reductions, hikes, and regularisations of the GST rate were discussed at length throughout the conference. On the front of the goods, there were rate reductions for four items, exemptions for three items, and GST regularisation for five items. All gambling winnings, including those from internet casinos, land-based casinos, and horse races, will be combined into a single category and taxed at a rate of 28% of their whole value. For instance, if a person bets 1,000 rupees and wins 1,500 rupees, then the player will owe 28 percent tax on the total of 1,500 rupees. In the future, there will be no differentiation made between games of skill and games of chance when it comes to the realm of online gaming.

This means that regardless of the type of game you play, the gains you make from playing that game will be subject to a GST tax rate of 28%. It is possible that this action will deal a significant damage to fantasy gaming platforms such as Dream11, MPL, and MyTeam11, all of which promote themselves as being games of skill.

This abrupt about-face comes just a few days after India’s Ministry of Electronics and Information Technology (MeitY) gave the industry the opportunity to decide for themselves which forms of online gaming would be legal in the country. For its part, the government would evaluate these games by appointing a number of different self-regulatory organisations (SROs), which would be made up of industry professionals. Recent developments include the submission of bids for acting as SROs by three organisations, which collectively represent over 200 gambling websites.

On the other hand, the Minister of Finance Nirmala Sitharaman pointed out that this position was totally regulatory, whereas the other position is purely tax-based. Despite this, they are going to align their stance with that of MeitY. The FM went on to emphasise that the GST council does not consider online games to be those of skill or chance but rather as ones that provide value for players.

Exceptions are made for medications used to treat life-threatening conditions.
Importation of drugs identified as being related to cancer, certain medications for uncommon disorders, and food items that are essential for medical purposes were among of the categories of goods and services that qualified for GST exemption. Raw cotton sales from farmers to cooperatives were one of the things that got brought into compliance. Regarding the provision of services, the launch of satellite services carried out by private organisations will not be included in the purview of the GST.

The previously challenged threshold of 18% will now be reduced to 5% for the purpose of calculating the Goods and Services Tax (GST) applicable to food and beverages consumed within a movie theatre. Notably, the Goods and Services Tax (GST) is paid at a rate of 5% on the consumption of food and beverages in restaurants.

The introduction of GST benches will take place in stages.

Concerning the question of whether or not each state should have GST benches, the council decided that the process should begin in cities that currently have high-court benches.
